The Guarantee Fund for Compulsory Insurance

In the event of a traffic accident with an uninsured, unidentified or insolvent driver, the victim can be compensated by applying to the Compulsory Insurance Guarantee Fund (FGAO), your car insurance comparator.

 

Small note in passing: the assumption of responsibility for a claim by the FGAO does not exempt from the application of certain auto deductibles , such as the deductible of 500 euros in case of a collision with a wild animal, in auto insurance.

Enter the FGAO in the event of a traffic accident

Conditions of the car or motorcycle claim

For the FGAO to intervene, it is necessary that the traffic accident took place in metropolitan France or in the Dom-Com. It must also concern:

  • a land motor vehicle,
  • or a person traveling on public roads, such as pedestrians, rollerblades, bicycles or scooters,
  • or a wild animal,
  • or a pet whose owner is unidentified or uninsured.

Are excluded from this procedure, when they are victims of the accident, the thieves of the vehicle, or the driver himself (he will be covered by the guarantee driver if he has subscribed).

Compensation damages: bodily, and material

The Fund covers bodily injuries (except those of the car or motorcycle driver) without limitation of the amount if the person responsible for the loss is unknown or uninsured.
Property damage   is compensated up to € 1,120,000 million, but under certain conditions:

  • if the perpetrator is unidentified, and the victim has suffered bodily injury,
  • or if the manager is not insured.

How to enter the Guarantee Fund

To seize the Fund, all you have to do is fill out a claim by registered letter with acknowledgment of receipt. The description of the damage and supporting documents must be included. You have three years to enter the FGAO if the identity of the person responsible for the accident is unknown. If the latter is identified, you have only one year to act.

International traffic accident

The FGAO can be seized, under certain conditions, when the accident took place abroad or in France with a foreign vehicle. Situations can be extremely complex depending on the countries involved. Membership of the European Union and the green card system are crucial. The website of the FGAO has developed a very practical tool to identify the competent body to address its claim. Here are some examples of applications.

The origins of the Insurance Guarantees Fund

The FGAO was created in 1951 under the former name “Automobile Guarantee Fund”. It finds its origin in the increasing evolution of car traffic and the resulting accidents. Over time, its scope has expanded and the Fund has been given new functions, such as compensation for victims of bodily injury caused by hunting.

Financed by contributions from all: insurers, insured and uninsured

Private legal entity grouping all insurance companies approved in France, the Guarantee Fund for Compulsory Insurance covers the risks subject to an insurance obligation, hence its name. The obligation of insurance concerns, in particular, the automobile and the motorcycle.
According to article L421-4 of the French Insurance Code, it is financed by the contributions of insurance companies, insured motorists, and non-insured car accident managers.
